Mine Related Legislation
Legislation was passed and signed by Governor Richardson during the 2008 legislative session that changed the requirements for Self-Contained Self-Rescuers (SCSR’s). Chapter 69-8-16.B NMSA(New Mexico Statutes Annotated) required miners to test for recertification. Chapter 69-14-4.B NMSA vested the penalty requirements for emergency notification with the State Mine Inspector (SMI).
HB 80 changed the requirements for recertification to allow for continuing education or testing. It also added a third step to the appeal process to allow an operator to appeal a penalty to the Mining Safety Board This change was supported by the International Union of Operating Engineers and by the New Mexico Mining Association.
